These Terms of Service (“Terms”) govern your access to and use of the website located at tmchomeinnovations.com (the “Site”) and the services offered by TMC Home Innovations Inc. (“TMC Home Innovations,” “we,” “us,” or “our”). By accessing our Site, requesting a quote, engaging our services, or communicating with us through our website chat widget, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree with any part of these Terms, please do not use our Site or services.
1. WHO WE ARE
TMC Home Innovations Inc. is a corporation organized under the laws of the State of Florida, providing general home remodeling and renovation services, including kitchen remodels, bathroom remodels, and whole-home renovations, to residential customers throughout the Tampa Bay area (Pasco, Hillsborough, and Pinellas counties).

2. ELIGIBILITY AND AGE RESTRICTION
You must be at least 18 years of age to use our Site, request services, or communicate with us via our chat widget. By using our Site or engaging our services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.
Our Site and services are not directed to children under the age of 18, and we do not knowingly collect personal information from minors. If we learn that we have inadvertently collected personal information from a person under 18, we will delete that information from our records as soon as reasonably practicable.
If you are under 18 years of age, please do not submit any information through our Site, chat widget, or any other channel.
3. USE OF OUR WEBSITE
You agree to use our Site only for lawful purposes and in a manner that does not infringe on the rights of others or restrict their use and enjoyment of the Site. Prohibited uses include, but are not limited to:
- Using the Site for any unlawful purpose or in violation of any applicable federal, state, or local law or regulation;
- Attempting to gain unauthorized access to any portion of the Site, related systems, networks, or accounts;
- Interfering with, disrupting, or attempting to disrupt the operation of the Site or any servers or networks connected to the Site;
- Using any automated system, robot, spider, scraper, or similar tool to access, extract, or index the Site or its content;
- Submitting false, misleading, or fraudulent information through any form, chat widget, or other communication channel;
- Transmitting any virus, malware, or other malicious code;
- Impersonating any person or entity or misrepresenting your affiliation with any person or entity.
We reserve the right to refuse service, terminate accounts, remove content, or cancel projects at our sole discretion, particularly when we believe conduct violates these Terms or is harmful to us, our employees, our other customers, or any third party.
4. SERVICES WE PROVIDE
TMC Home Innovations Inc. provides general home remodeling and renovation services to residential property owners in the Tampa Bay area, including but not limited to kitchen remodeling, bathroom remodeling, whole-home renovations, interior and exterior improvements, and related construction and design services.
4.1 Service Estimates and Quotes. Estimates and quotes provided by TMC Home Innovations are based on the scope of work discussed and the site conditions known at the time of the estimate. Quotes are valid for thirty (30) days from the date issued unless otherwise stated in writing. Final project pricing may be adjusted based on change orders, unforeseen conditions discovered during construction (such as hidden water damage, structural issues, code compliance requirements, or concealed defects), material price changes, or client-requested modifications. All change orders must be documented and approved in writing before additional work is performed.
4.2 Service Schedule. We will make reasonable efforts to complete projects within the timeframes agreed upon in the written project agreement. However, project timelines are estimates and may be affected by factors outside our control, including but not limited to weather, material availability and supply chain delays, permitting and inspection timelines, subcontractor scheduling, and change orders. We are not liable for delays caused by such factors and will communicate with you promptly if any material delay is anticipated.
4.3 Property and Job Access. You agree to provide safe, reasonable, and timely access to the property and work areas during scheduled service hours. This includes clearing work areas, securing pets, providing access to water and electrical service as needed, and ensuring a safe working environment for our crew and subcontractors. If we are unable to access the property at the scheduled time and did not receive advance notice, we reserve the right to charge a reasonable trip or rescheduling fee.
4.4 Permits and Inspections. Where required by local jurisdiction, TMC Home Innovations will pull the appropriate building permits and coordinate required inspections. The cost of permits is either included in the written project agreement or invoiced as a separate line item and is the responsibility of the property owner unless otherwise agreed.
5. PAYMENT TERMS
5.1 Accepted Payment Methods. We accept payment by cash, check, credit card, ACH bank transfer, and financing through approved third-party lenders. Financing terms are set by the lender and are subject to credit approval; TMC Home Innovations is not the lender and does not control financing terms.
5.2 Payment Timing. Payment is due according to the schedule specified in the written project agreement. For most remodeling projects, a deposit is required to schedule the project and secure materials, with progress payments due at defined project milestones, and final payment due upon substantial completion. For smaller service work, payment is generally due upon completion unless other terms are agreed to in writing.
5.3 Late Payments. Invoices not paid by the due date may be subject to late fees and interest to the maximum extent permitted by applicable law. We reserve the right to suspend work, hold materials, or pause scheduling until past-due balances are resolved. You will be responsible for any reasonable collection costs, including attorneys’ fees, that we incur in pursuing overdue amounts to the extent permitted by law.
5.4 Returned Payments. If a check or electronic payment is returned unpaid for any reason (including insufficient funds, closed accounts, or stopped payment), you agree to reimburse us for any bank fees we incur, plus any additional fee permitted under Florida law. Any invoice paid by a returned payment will be considered unpaid until valid replacement payment is received.
6. CANCELLATIONS, RESCHEDULING, AND REFUNDS
6.1 Cancellation and Rescheduling. We understand that plans change. Cancellations and rescheduling requests are handled on a case-by-case basis. Please contact us as soon as possible if you need to cancel or reschedule so we can adjust our crew scheduling and material orders. Depending on how far a project has progressed, cancellations may be subject to a fee reflecting labor already performed, materials already ordered or delivered, permitting costs, and other non-recoverable costs we have incurred on your behalf.
6.2 Deposits. Deposits are used to secure your place in our project schedule and to order materials specific to your project. Deposits are non-refundable to the extent that we have already ordered custom materials, pulled permits, or performed pre-construction work. Where deposit funds remain after deducting these costs, any balance will be refunded to you.
6.3 Refunds. Refunds for work already performed are not typically issued. If you believe there is an issue with completed work, please refer to Section 7 (Satisfaction Commitment).
7. SATISFACTION COMMITMENT
We stand behind the quality of our work. If you identify an issue with services we have performed, please notify us in writing (email is acceptable) within the warranty period specified in your written project agreement. Upon receiving timely notice, we will inspect the work and, at our sole discretion, repair, replace, or otherwise remedy any workmanship defect that falls within the scope of the applicable warranty. Repair, replacement, or reasonable remediation of a workmanship defect is your sole and exclusive remedy for any claim relating to the quality of our services. Warranties do not cover damage caused by misuse, neglect, ordinary wear and tear, alterations by third parties, acts of nature, or conditions outside our control.
8. SMS AND TEXT MESSAGE TERMS
By providing your phone number and confirming your consent to receive text messages through our website chat widget or during any communication with our team, you agree to the following SMS terms in addition to our Privacy Policy.
8.1 Program Name. TMC Home Innovations Inc. SMS messaging program.
8.2 Age Requirement. You must be at least 18 years of age to enroll in and receive text messages from our SMS program. By providing your phone number and confirming your consent, you represent and warrant that you are at least 18 years old. We do not knowingly send text messages to minors. If you believe a minor has been enrolled in our SMS program, please contact us immediately at (813) 426-0823 or service@mail.tmchomeinnovations.com and we will remove the number from our system.
8.3 Transactional Messaging Only. Our SMS program is a transactional-only program. Message types you may receive include:
- Appointment confirmations and scheduling messages
- Appointment reminders (day-of and/or day-before)
- Quote and estimate follow-ups
- Service completion notifications and next-step instructions
- Project status updates during active work
- Billing and payment-related updates
- Responses to questions you have initiated with us
We do not send promotional or marketing text messages through this program.
8.4 Message Frequency. Message frequency varies based on your active projects and communications with us. A typical customer receives approximately 2 to 6 messages per month.
8.5 Message and Data Rates. Message and data rates may apply. Check with your mobile carrier for details about your plan.
8.6 How to Get Help. Reply HELP to any message you receive from us for assistance. You may also contact us directly at (813) 426-0823 or service@mail.tmchomeinnovations.com for help with the SMS program.
8.7 How to Opt Out. You may opt out of our SMS program at any time by replying STOP to any message. After you reply STOP, you will receive one final confirmation message acknowledging that you have been unsubscribed, and you will not receive further text messages from us unless you opt back in. To opt back in at any time, reply START to a previous message or contact us and request to be re-enrolled.
8.8 Consent Is Not a Condition of Purchase. Your consent to receive text messages is not required as a condition of purchasing any goods or services from TMC Home Innovations Inc. You may still request quotes, schedule services, and communicate with us by phone, email, or our website chat widget without enrolling in SMS.
8.9 Carrier Disclaimer. Carriers are not liable for delayed or undelivered messages. Supported carriers include AT&T, T-Mobile, Verizon Wireless, Sprint, U.S. Cellular, Boost Mobile, MetroPCS, Cricket, and most other major U.S. wireless carriers.
8.10 Sample Messages.

8.11 No Sharing of Mobile Information.
NO SHARING OF MOBILE INFORMATION
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All categories of personal information are excluded from being shared under this clause. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
Your phone number and SMS consent will never be sold, rented, traded, or transferred to any third party for that third party’s own marketing purposes.
9. LIABILITY AND INSURANCE
9.1 Insurance. TMC Home Innovations Inc. carries general liability insurance appropriate to the services we provide. A Certificate of Insurance is available upon written request.
9.2 Property Damage. We take reasonable care while working on your property. In the unlikely event that our crew causes direct physical damage to your property while performing services, notify us in writing (email acceptable) as soon as reasonably possible after you discover the damage so we can promptly investigate and remedy the issue.
9.3 Damage Exclusions. We are not responsible for the following, which are common in remodeling and renovation work and often outside our control:
- Pre-existing conditions discovered during demolition or construction, including hidden water damage, mold, termite damage, structural deficiencies, outdated wiring, corroded plumbing, and asbestos or lead-based paint in older homes;
- Damage to items that were not disclosed to us in advance, including in-wall wiring or plumbing routed in non-standard locations, buried utility lines outside marked service areas, and irrigation or landscape lighting systems not identified on plans;
- Cracking, settling, or cosmetic damage to drywall, tile, grout, plaster, or trim caused by normal building movement, vibration from adjacent work, or subfloor deflection;
- Damage to fragile items that were not removed from the work area by the homeowner, including artwork, mirrors, glassware, electronics, and collectibles;
- Damage to landscaping, driveways, or lawns caused by necessary equipment, dumpsters, and material staging in normal work paths;
- Ordinary dust and debris associated with construction, which we mitigate with dust barriers and cleanup but cannot eliminate entirely;
- Damage caused by third parties not under our direct control, including customer-hired subcontractors, utility companies, or delivery vendors;
- Latent defects in materials supplied by the manufacturer, which are covered by the applicable manufacturer’s warranty rather than our workmanship warranty;
- Damage caused by acts of nature, including hurricanes, floods, lightning, fire, and severe weather events.
9.4 Limitation of Liability. To the maximum extent permitted by applicable law, our total aggregate liability to you for any claim arising out of or related to the services we provide, these Terms, or our Site is limited to the amount you actually paid to TMC Home Innovations Inc. for the specific project or service giving rise to the claim. In no event shall we be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, loss of use, loss of enjoyment, or diminished property value, even if we have been advised of the possibility of such damages.
10. INTELLECTUAL PROPERTY
All content on our Site — including text, graphics, logos, photographs, videos, project galleries, design layouts, and the compilation of all of the foregoing — is the property of TMC Home Innovations Inc. or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. “TMC Home Innovations” and any associated logos are trademarks of TMC Home Innovations Inc. You may not copy, reproduce, distribute, publish, display, or create derivative works from any Site content without our prior written permission.
11. CUSTOMER PHOTOS AND TESTIMONIALS
From time to time we may photograph or video-record completed projects for marketing, portfolio, website, and social media purposes. If you do not wish for photographs of your home or project to be used in this manner, please notify us in writing before work begins. If you provide us with a written testimonial, review, or before-and-after photograph, you grant us a non-exclusive, royalty-free, perpetual license to use, reproduce, and display that content in our marketing materials, on our Site, and on our social media channels, with your first name (or a preferred pseudonym) and general project location (city, no street address). You may request removal of your testimonial or project photos from active marketing use at any time by emailing service@mail.tmchomeinnovations.com.
12. DISCLAIMERS
Our Site and its content are provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not guarantee that our Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
Results from remodeling and renovation projects vary based on site conditions, homeowner preferences, material selections, and other factors, and we do not guarantee any specific outcome, resale value, energy savings, or subjective satisfaction level beyond the workmanship warranty stated in your written project agreement and Section 7 of these Terms.
13. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless TMC Home Innovations Inc., its officers, directors, employees, contractors, subcontractors, and agents from and against any and all claims, damages, losses, liabilities, judgments, settlements, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of our Site or services; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any content or information you submit to us through our Site, chat widget, or other channels.
14. GOVERNING LAW AND DISPUTES
These Terms and any dispute arising out of or related to these Terms, our Site, or our services shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles. The exclusive venue for any dispute that cannot be resolved informally shall be the state or federal courts located in Pasco County, Florida, and you consent to the personal jurisdiction of those courts.
Pre-Dispute Notice. Before initiating any formal legal action, you agree to provide us with written notice describing the nature of the dispute and the relief you seek, sent to the address in Section 1 or by email to service@mail.tmchomeinnovations.com. You agree to give us at least thirty (30) days from the date we receive your notice to investigate and attempt to resolve the matter informally before any formal proceeding is initiated.
15. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes in our services, technology, applicable law, or business practices. When we do, we will revise the “Last Updated” date at the top of this page. Continued use of our Site or services after the “Last Updated” date changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
16. SEVERABILITY
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
17. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy and any written project agreement or estimate you sign with us, constitute the entire agreement between you and TMC Home Innovations Inc. with respect to your use of our Site and our services, and supersede all prior or contemporaneous communications, whether electronic, oral, or written.
